WESTCOTT DESIGNS “BLACK FRIDAY GIVEAWAY” OFFICIAL RULES

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED BY LAW.

1. SPONSOR

The Black Friday Giveaway (the “Giveaway”) is sponsored by Westcott Designs (the “Sponsor”), located at 23910 N. 19th Ave. Suite 10, Phoenix, AZ 85085, and is subject to the following terms and conditions (the “Official Rules”).

2. ELIGIBILITY

The Giveaway is open to legal residents of the fifty (50) United States and the District of Columbia who are at least eighteen (18) years of age or the legal age of majority in their state of residence at the time of entry. Employees, officers, and directors of Westcott Designs, its affiliates, subsidiaries, advertising and promotion agencies, and their immediate family members (spouses, parents, siblings, and children) and household members (whether related or not) are not eligible to enter or win.

The Giveaway is subject to all applicable federal, state, and local laws and regulations and is void where prohibited.

3. PROMOTION PERIOD

The Giveaway begins on November 28, 2025, at 12:00 AM Pacific Standard Time (“PST”) and ends on December 1, 2025, at 11:59 PM PST (the “Promotion Period”). Entries received outside the Promotion Period will not be eligible.

4. HOW TO ENTER

Participants may enter the Giveaway through the following methods:

A. FREE ENTRY (NO PURCHASE NECESSARY)

  • Eligible individuals may receive one (1) entry by completing the official giveaway registration form available on the Westcott Designs website during the Promotion Period.

B. SOCIAL MEDIA BONUS ENTRIES

  • Participants may earn additional entries by engaging with Westcott Designs’ official social media accounts as follows:
    • Facebook: Like, follow, share, tag = 1 entry (per action – i.e. if you like, follow, share and tag = 4 entries in total per user per social platform).
    • Instagram: Like, follow, and share = 1 entry (per action)
    • TikTok: Like, follow, and share = 1 entry (per action)
    • YouTube: Like & subscribe = 1 entry (per action)
  • Social media accounts must remain public, and entries must be visible at the time of the drawing to be considered valid.
  • Limited to 4 entries per user per social media platform.
  • Any falsified entries will be disqualified from the Giveaway.

C. PURCHASE-BASED ENTRY

  • Participants will receive one (1) entry for every $1 spent on Westcott Designs merchandise or products purchased through the official Westcott Designs website during the Promotion Period.
  • No entry limit applies to purchase-based entries.

Entries that are late, illegible, incomplete, misdirected, or that do not adhere to these Official Rules may be disqualified at the Sponsor’s sole discretion.

5. PRIZE DETAILS

The Grand Prize is Westcott Designs’ accessories and installation of said products on the customer’s provided vehicle. This Giveaway prize does NOT include wheels or tires. The prize includes Westcott Designs’ manufactured products currently designed for the winner’s vehicle year, make, and model. The retail value is estimated at $2,500 for parts and labor for installation.

  • The prize is non-transferable, non-exchangeable, and has no cash alternative.
  • Sponsor reserves the right to substitute the prize with another of equal or greater value if necessary.
  • All taxes, fees, and expenses associated with the acceptance and use of the prize are the sole responsibility of the winner.

6. WINNER SELECTION & NOTIFICATION

  • The potential winner(s) will be randomly selected in a drawing conducted by the Sponsor on or about December 10, 2025.
  • The potential winner(s) will be notified via email and/or direct message on social media within five (5) business days of the drawing.
  • The winner must respond within seven (7) days of notification. If a potential winner fails to respond within this timeframe or is deemed ineligible, an alternate winner may be selected.

To claim the prize, the winner must complete the following:

  • Sign and return an Affidavit of Eligibility, Liability Release, and Publicity Release, as permitted by law.
  • Provide proof of identity and eligibility.
  • Comply with any additional requirements set forth by the Sponsor.

Failure to comply may result in disqualification and selection of an alternate winner.

7. GENERAL CONDITIONS

By entering, participants agree to:

  • Abide by these Official Rules and all decisions of the Sponsor, which are final and binding.
  • Release and hold harmless Westcott Designs, its affiliates, subsidiaries, officers, directors, employees, and agents from any liability arising from participation in the Giveaway or acceptance and use of the prize.
  • Allow the Sponsor to use their name, likeness, image, and/or submitted content for promotional purposes without further compensation, unless prohibited by law.

 

8. LIMITATIONS OF LIABILITY

The Sponsor is not responsible for:

  • Lost, late, misdirected, or incomplete entries.
  • Technical failures, human error, or any other factor that may impair the operation of the Giveaway.
  • Any injury, loss, or damage related to participation in the Giveaway or acceptance of the prize.

9. DISPUTE RESOLUTION

This Giveaway is governed by the laws of the State of Arizona, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the state or federal courts located in Maricopa County, AZ. Participants agree to waive any right to a jury trial or to bring a class action lawsuit.

10. PRIVACY POLICY

Personal information collected in connection with this Giveaway will be used solely for the administration of the Giveaway and will not be sold or shared with third parties.

When participating in the Promotion, you expressly agree to receive email promotional communications from Sponsor unless and until you opt-out at any time. This Promotion including information collected from Participants is subject to and governed by Sponsor’s Privacy Policy.

12. SOCIAL MEDIA DISCLOSURE

This Giveaway is in no way sponsored, endorsed, administered by, or associated with Facebook, Instagram, TikTok, YouTube, or any other social media platforms. Any questions, comments, or complaints should be directed to Westcott Designs and not to the social media platforms.

13. INDEMNIFICATION

The Sponsor and its affiliates, owners, director, officers, agents and assigns (together, the “Released Parties”) are not responsible for: (a) any incorrect or inaccurate information, whether caused by Entrant, or programming associated with or used in the Giveaway; (b) technical failures of any kind, including but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (c) unauthorized human intervention in any part of the entry process or the Giveaway; (d) technical or human error, which may occur in the administration of the Giveaway or the processing of entries; or (e) any injury or damage to persons or property, which may be caused, directly or indirectly, in whole or in part, from an/any Entrant’s participation in the Giveaway or receipt or use or misuse of any prize.

If for any reason an Entrant’s entry is confirmed to have been erroneously deleted, lost or otherwise destroyed or corrupted, Entrant’s sole remedy is another entry in the Giveaway. No more than the stated number of prizes will be awarded. If, for any reason, the Giveaway cannot be executed as planned, including, but not limited to, any governmental order, force majeure, epidemic/pandemic, social media mandate, printing, administrative or other error of any kind, transmission failure, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor that corrupt or affect the security, administration, fairness, integrity or proper conduct of the Giveaway, or if the Giveaway is compromised or becomes technically corrupted in any way, electronically or otherwise, Sponsor reserves the right, in its sole discretion, to cancel, modify or terminate the Giveaway and, if terminated before the original end date, to select the winners from among all eligible, non-suspect entries received as of the date/time of termination.

BY ENTERING THE GIVEAWAY, ENTRANT AGREES THAT, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW:

  1. ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE GIVEAWAY, OR ANY PRIZE(S) AWARDED WILL BE LIMITED TO ACTUAL, OUT-OF-POCKET COSTS INCURRED (IF ANY) NOT TO EXCEED TEN DOLLARS ($10.00), BUT IN NO EVENT WILL ATTORNEYS’ FEES BE AWARDED OR RECOVERABLE;
  2. UNDER NO CIRCUMSTANCES WILL ANY ENTRANT BE PERMITTED TO OBTAIN ANY AWARD FOR, AND ENTRANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, LOST PROFITS AND/OR ANY OTHER DAMAGES AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED.

SOME JURISDICTIONS DO NOT ALLOW THE FOREGOING LIMITATIONS OR EXCLUSION OF LIABILITY, SO THE ABOVE MAY NOT APPLY TO YOU.

EACH ENTRANT UNDERSTANDS AND AGREES THAT ALL RIGHTS UNDER SECTION 1542 OF THE CIVIL CODE OF CALIFORNIA AND ANY SIMILAR LAW OF ANY STATE OR TERRITORY OF THE UNITED STATES ARE HEREBY EXPRESSLY WAIVED BY HIM/HER AGAINST THE GIVEAWAY ENTITIES.

SECTION 1542 READS AS FOLLOWS:

“CERTAIN CLAIMS NOT AFFECTED BY A GENERAL RELEASE. A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE, AND THAT IF KNOWN BY HIM OR HER WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASING PARTY.”
